NUMBER: Policy III-7-1  (Formerly Policy III-9)

 

 

The University retains the right to restrict time, place, and manner of solicitation of articles or services in order to protect the educational environment of the institution. This policy covers all solicitations including but not limited to political, religious, and other organizations and individuals representing public policy issues.  Content must adhere to university and Board of Regent policy.

1.                  General criteria

A.                Individuals or organizations wishing to conduct solicitation on campus must contact Surbeck Center (SC) staff at least three days in advance of the desired reservation date to:

1)                  Complete a Request for Solicitation On-Campus form.

2)                  Reserve space.

3)                  Determine applicable fees in accordance with SDSM&T Policy 6-A-11, Assessing User Fees.

B.                 Solicitations in the residence halls are restricted to campus organizations; permission of the Director of Residence Life must be obtained.

C.                 Sales of food items on campus are not allowed except with the written authorization of the SDSMT Dining Services Director.

D.                Sales by an individual solely for personal gain are not permitted.

E.                 Products or services may be sold on campus only when they meet a need not presently being provided by the university.

F.                  Raffles must be in compliance with state codified law regarding ‘lottery’.

G.                Organizations/individuals wishing to conduct mail solicitations must comply with the Family Education Rights and Privacy Act and must obtain permission from:

1)                  The Director of Human Resources SDSM&T to access faculty and staff information. 

2)                  The Director of the Registrar and Director of Academic Services to access student information.

2.                  External users

A.                External users must have written authorization to solicit on campus.  Permission is obtained through a completed and submitted Request for Solicitation On-Campus form.

B.                 All solicitations by external users are limited to their assigned locations and a maximum of ten days per year with no more than two days per seven day period.

C.                 External users will be charged a standard fee based on SDSM&T’s usual and customary rates. Execution of a formal letter of agreement is required in accordance with SDSM&T Policy 6-A-11, Assessing User Fees.

3.                  Internal users (departments, offices, student organizations)

A.                Internal users and student organizations wishing to invite external entities on to campus must register with SC staff, complete the SDSMT Sponsorship Request Form, and receive formal authorization (see the Assessing User Fees policy).

B.                 Student organizations wishing to conduct sales or solicitations on or off campus must complete the SDSMT Student Organization Fundraiser Form and submit to the Student Activities and Leadership Center (SALC).  Requests are not guaranteed, but all efforts will be made to accommodate. Upon approval from the SALC staff, the form will be forwarded to the SC staff to begin the reservation process.
