Judicial and Appellate Boards

1.
Student disciplinary hearings at SDSM&T shall be conducted in accordance
with Board of Regents Policy 3:4 by one of the following,
A.
The Student Conduct Administrator (or his/her designee, e.g. Hall
Directors with respect to residence hall policy violations)
B.
A designated student conduct body.
1)
The Residence Hall Student Conduct Board (RHSCB) may conduct student
disciplinary hearings based on alleged violations of policy, which occur within
the residence halls and involve infractions by students residing on campus.
2)
The Interfraternity Council Student Conduct Board (IFCSCB )may conduct
student organization disciplinary hearings based on alleged violations of
policy, which occur within the residences of recognized student organizations
within the Interfraternity Council, or which involve infractions by
organizations that are members of the Interfraternity Council.
3)
The SDSM&T Student Conduct Board (SCB) may carry out student or student
organization disciplinary hearings.

Student conduct bodies will prepare findings, conclusions and sanctions
which are then presented to the Student Conduct Administrator or designee.
3.
The Student Conduct Administrator or designee may accept or reject the
student conduct body’s findings, conclusions and sanctions.
4.
The Student Conduct Administrator or designee will notify the respondent
of the outcome of the hearing. If the respondent is found responsible and the
Student Conduct Administrator concurs with that finding, the Student Conduct
Administrator will impose any sanctions and track student compliance.
5.
A decision reached by a student conduct body or a sanction imposed by the
Student Conduct Administrator may be appealed per BOR policy.
A.
The Director of Residence Life will serve as the appellate board for
decisions of his/her designee, and the RHSCB.
B.
The Vice President for Student Affairs and Dean of Students will serve as
the appellate body for decisions of the Student Conduct Administrator including
recommendations from the SCB and the IFCSCB.
6.
The SCB shall consist of seven members: four faculty members, two student
representatives and the Student Conduct Administrator, who shall serve as chair.
Each member shall have one vote, except for the Student Conduct Administrator,
who shall have one vote only in the case of a tie. The SCB may conduct business
with a minimum of two faculty members, one student member and the chair present.
7.
The RHSCB shall consist of four members: at least three student
representatives as appointed by Residence Hall Association and a Hall Director
who will serve as the chair. Each member shall have one vote, except for the
Hall Director, who shall have one vote only in the case of a tie. The RHSCB may
conduct business with a minimum of two student members and a Hall Director
present.
8.
The IFCSCB shall consist of one student representative from each of the
Greek organizations belonging to the Interfraternity Council. Each member shall
have one vote, except for the chair, who shall have one vote only in the case of
a tie. The Student Conduct Administrator will serve as advisor and chair for the
IFCSCB. The IFCSCB may conduct business with a minimum of three student members
and the chair/advisor present.
